1. PLATFORM DETAILS AND COMPANY INFORMATION
Kamour is a digital health facilitation platform and brand owned and operated by Kapeefit Health Brand Private Limited, a company incorporated under the Companies Act, 2013.
The registered office of the Company is situated at 536, Indra Nagar, Bareilly, Uttar Pradesh – 243122, India, and the branch office is located at Anoop Tower, P-5/3, Stadium Road, DD Puram, Bareilly, Uttar Pradesh – 243122, India.
The Platform is accessible through the website https://www.kamour.in and associated digital interfaces. All official communication may be addressed to [email protected] or customer support at +91-9045599288. The Platform operates strictly within the legal and regulatory framework applicable in India.
2. DEFINITIONS AND INTERPRETATION
“Platform” means the Kamour website and associated digital systems.
“User” means any individual accessing or using the Platform.
“Registered Medical Practitioner” or “RMP” means a medical practitioner registered with a recognized medical council in India, including practitioners holding a Bachelor of Ayurvedic Medicine and Surgery (BAMS) degree registered under the National Commission for Indian System of Medicine (NCISM) or a relevant State Ayurvedic Medical Council, and practicing strictly within their authorized scope of Ayurveda and applicable law.
“Practitioner” or “Doctor” refers to such independent RMPs providing consultation in their professional capacity.
“Consultation” means an online interaction between a User and an RMP through permitted digital modes.
“Wellness Plan” means a practitioner-formulated plan that may include lifestyle guidance, Ayurvedic recommendations, and practitioner-recommended wellness products.
Headings are for convenience only and shall not affect interpretation.
3. ACCEPTANCE OF TERMS
By accessing or using the Platform, the User acknowledges having read, understood, and agreed to be bound by these Terms, the Privacy Policy, and related policies. If the User does not agree, they must immediately discontinue use of the Platform.
4. ELIGIBILITY
The Platform is intended only for individuals 18 years of age or older who are legally competent under Indian law. By using the Platform, Users represent that all information provided is accurate and complete. Kamour reserves the right to suspend or terminate access if eligibility requirements are not met.
5. NATURE OF THE PLATFORM AND SCOPE OF SERVICES
Kamour operates solely as a technology-enabled digital health facilitation platform and does not itself practice medicine.
Kamour does not provide medical advice, diagnosis, or treatment and does not function as a hospital, clinic, pharmacy, or diagnostic center.
All medical advice, diagnosis, treatment, prescriptions, and follow-up care are provided exclusively by independent Registered Medical Practitioners (RMPs) using the Platform in their professional capacity. Kamour’s role is limited to providing technological, logistical, and administrative support.
Any prescription generated through the Platform shall be issued solely by an RMP, in compliance with applicable Indian laws, including the Drugs and Cosmetics Act and Rules and the Telemedicine Practice Guidelines. Kamour does not alter, influence, or mandate prescriptions.
6. NATURE OF SERVICE
The Platform operates primarily as an online store for vitamins, dietary supplements, nutraceuticals, Ayurvedic and other wellness products that are generally available without a prescription in India. Users may purchase such products directly, without any mandatory doctor consultation, subject to age and eligibility requirements.
Optional online consultations with qualified Registered Medical Practitioners (RMPs) are provided to Users who wish to seek professional guidance before purchasing or using any product. Where a Practitioner issues a prescription or specific usage advice, Users must follow such directions and applicable laws.
Kamour does not guarantee cure, treatment, or disease‑specific outcomes for any product and does not permit products to be advertised or sold as having properties to prevent, treat, or cure any human disease.
7. DOCTOR–PATIENT RELATIONSHIP
A direct and exclusive doctor–patient relationship is established between the User and the RMP during consultation. Kamour is not a party to this relationship and does not interfere with clinical judgment, diagnosis, treatment decisions, or follow-up care.
8. PRACTITIONER INDEPENDENCE AND CONFLICT OF INTEREST
Practitioners act as independent professionals and are not employees, agents, or representatives of Kamour. Practitioners remain free to prescribe or recommend any medicines or wellness products they consider appropriate and are under no obligation to prescribe Kamour-branded products.
Where a Practitioner recommends a Kamour product, the User may choose to purchase it through Kamour or any other lawful channel. Kamour does not mandate exclusive fulfillment through the Platform.
9. TELECONSULTATION LIMITATIONS AND CONSENT
Teleconsultation services are not intended for emergencies. Users experiencing severe or life-threatening symptoms must seek immediate in-person medical care.
By initiating a consultation on the Platform, the User provides implied consent to teleconsultation in accordance with India’s Telemedicine Practice Guidelines. Where required by law, explicit consent shall be obtained via email, text message, or verbal confirmation and documented by the Practitioner.
Users acknowledge that certain categories of medicines may not be prescribed via teleconsultation under applicable law and may require in-person evaluation.
10. AYURVEDIC AND WELLNESS-BASED CARE
Ayurvedic or wellness-based care provided through the Platform is rendered by qualified RMPs in accordance with their professional judgment, scope of practice, and applicable laws. Kamour makes no guarantee of cure or outcome, and results may vary based on individual factors.
11. USER OBLIGATIONS
Users must provide accurate and complete health information and follow practitioner instructions responsibly. Kamour shall not be liable for consequences arising from inaccurate disclosures, non-compliance, or misuse of advice or products.
12. FEES, BILLING, AND REFUNDS
Consultation fees are payable in advance and are non-refundable except where mandated by law or Platform policy. Refunds, where applicable, shall be processed to the original mode of payment within a reasonable time.
13. PRACTITIONER-RECOMMENDED PRODUCTS
Product fulfillment may be carried out by authorized third-party partners. Kamour makes no guarantees regarding effectiveness or outcomes and does not influence practitioner recommendations.
14. NO MEDICAL OR PERFORMANCE CLAIMS
Kamour makes no express or implied guarantees regarding medical outcomes or performance. All content complies with the Drugs and Cosmetics Act, 1940, the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, and applicable AYUSH advertising guidelines.
The Platform does not promote any product as a guaranteed cure for erectile dysfunction, premature ejaculation, infertility, or any specific disease.
15. INTELLECTUAL PROPERTY
All Platform content and materials are the intellectual property of Kamour or its licensors and are protected by law.
16. THIRD-PARTY LINKS
Kamour does not control or endorse third-party services linked on the Platform and assumes no responsibility for them.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Kamour shall not be liable for practitioner conduct, medical outcomes, or indirect or consequential damages. Aggregate liability shall not exceed the amount paid for the relevant service.
18. INDEMNITY
Users agree to indemnify Kamour against claims arising from misuse of the Platform, violation of these Terms, or actions contrary to practitioner instructions.
19. PRIVACY, RECORDS, AND DATA RETENTION
Kamour processes personal and health data in accordance with its Privacy Policy and applicable law. Consultation records, prescriptions, and user consents may be stored for the period required under medical and telemedicine regulations for regulatory and medico-legal purposes.
20. MISUSE AND TERMINATION
Abusive behavior, harassment, indecent conduct during consultations, or misuse of the Platform may result in immediate termination and reporting to authorities where required.
21. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by Indian law. Disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, with jurisdiction in Bareilly, Uttar Pradesh, India.
22. MODIFICATION OF TERMS
Kamour may update these Terms from time to time. Continued use constitutes acceptance.

Any grievance relating to the professional conduct of an RMP may also be addressed to the relevant State Medical Council or statutory authority with whom the Practitioner is registered.
